If you have a lawyer who told you that that TOS is them claiming your copyright, then I suggest that you find a lawyer that actually has the ability to read a contract perhaps one that can actually read and speak English. Because the one you have in that case is incompetent.

 

Please note I said nothing about whether their advice to you not to upload to NexusMods was appropriate or not. It is entirely possible that it is not a great idea for you specifically to upload your mods to the Nexus. I make no claims that it is.

 

What I said was they are not claiming your copyright. There is nothing in their TOS about them claiming your rights. The only thing that is in the TOS about that sort of thing is that you grant them a license. And I repeat this for emphasis you grant them a license to provide the mod you uploaded to them for the explicit purpose of making it available for others to download.

 

This is not claiming your copyright. You still own the mod you still have ownership of everything in the mod that you had ownership of before you uploaded it to them.

 

It is merely providing them the right to redistribute your mod, which is explicitly what you were telling them to do when you uploaded it to them in the first place. The only sticking point that should be in your caw about that is the fact that they also say that you can't revoke this license. In other words if you upload it to them you are saying that they have the license to redistribute it forever.

When you upload/post anything to nexusmods you agree to their licensing agreement. Essentially you still own your own content, but you give nexus a license to use your content. The stipulations of that license are written in the terms and conditions.
 

The agreement between you and their contract is established the very first time you’ve ever checked the “I agree” box to their terms and conditions. This box usually appears when finalizing your newly created account or when the terms of service has been updated and you’re trying to sign in.  

 

You can sue for copyright infringement, but the only context in which you will win, is if nexus somehow uploaded your content that you yourself had never uploaded there before. 

 

At the end of the day I respect whatever decision mod authors make in where they want to upload/host their content.

Not only that, by uploading to Nexus you agree to all your mods to become part of their 'modpacks' which I have been against since day 1.

 

 

Tbh, I don't mind my mod became part of their modpacks. If they want to earn $ with my mod, they are free to do it as long as they credit me.

 

But I cannot tolerate their insufferable admin/mod that lack of consistency and competency in managing the site. You cannot even jokes at their site without risk getting your mod delete... neither do they even give you enough time and chances to modify your mod to comply with their site. 

 

Even LL mod like Psalam would be kind enough to send pm to tell you "Hey, your mod didn't comply with our site ToS, can you modify it in order to comply with it?" and give you time to modify it. Nexus be like.... "uh uh!!! wE DeLEte!! wE n0 g!ve fUck!!... HeRe iS sOmE ..l.. 4 u". 

 

I hardly even bother posting nor greet at nexus forum anymore due to how hostile it was, the only post I make there now is all about troubleshooting and nothing else.

And at which point does your "ownership" and copyright end and theirs begin if they can reproduce and share on other platforms and its irrevocable? Its certainly not standard where I am from. In the EU we have actual laws, for the better or worse. I wasn't aware though that such clauses were in affect before they were bought.

That's just legal mumbo-jumbo. Technically, yes, mod makers are granting Nexus licence for their mods, not ownership. But the licencing terms are so broad that in practical sense it can be seen as granting ownership. For example, Nexus has the right to "prepare derivative works of" any uploaded content. They can use Ivy's voice files in AI voice cloning without asking for VA's permission.

It's like back in "socialist" East Germany... according to the constitution, the population owned all the country's businesses and companies—but in practice, they had no actual control—therefore, they were "disenfranchised owners."

But the right to control one's own property is arguably the most important element of ownership (of anything at all)... if this is no longer present, ownership is nothing more than a "paper tiger."

If you find website licensing terms of service to be too broad, you generally have two courses of action: accept the terms as written or decline to use the service.

 

These terms are presented as "take it or leave it" agreements (EULA). You implicitly consent (usually through a clickable "I agree" button) to the terms by using the service, even if you don't read them.

  1. Acceptance by Use: By continuing to use the website or service, you are acknowledging that you agree to be bound by their terms.
  2. Refusal: if you disagree with any of the terms, your only recourse is to stop using the service.

That being said the problems with EULAs stem from their inherent nature of being non-negotiable as well as restrictive clauses that often conflict with consumer expectations and rights.

 

So its not necessarily a copyright/ ownership issue, its more of contractual issue, where they've written it as vaguely and all encompassing as possible, that it now starts to mimic copyright/ ownership through its licensing.

So are these "new" terms really that much different than what Nexus already had, or is it just the new owners re-iterating what's already in place?

 

Remember a few years ago Nexus under the original owner already claimed license to the mods, which led to an exodus of many mod makers from the site, as well as a lot of hand wringing and gnashing of teeth.  The reality is I don't think much changed since then.

 

As far as competition, I'd love to see it as I think competition makes things better for the end user.  It's not as easy as it sounds though.  When Nexus had the last exodus a bunch of authors got together and were going to create the Nexus killing Mod Sanctum hosting site.  I think they still have an active Discord page, but not sure if the website ever really got off the ground.

 

Too many people are just begging for excuses to be worried about something.

The only reason I have Nexus account is because when I created it, it was still a very small, niche and obscure website that nobody has heard about and internet was still largely a Wild West.

The reason I have LL account is because it still has that spark of freedom that whole of Internet used to have before it became corporised.

I also simply don't believe in bans on adult content. Unless governments institute total and global control over the web, people will always find ways to get what they want. It will just be more dangerous for users and also remove any tax incomes from related businesses because they will be gone off to the dark web. Banning something that has demand will never really make it go away. It will just make it so that instead of legitimate companies these things will be handled by criminal gangs and syndicates - meaning, society at large will be the loser. Though of course, governments don't have a mental capacity to think that far. Or learn from history.

This is why Microsoft has turned Windows into a deep spyware/malware suite - because it's profitable to:

1) sell all the information it can possibly collect on its users to third parties - as many third parties as it can find

2) set up ransomware (your data on your hard drive being involuntarily and invisibly moved to OneDrive )

3) set up another ransomware (BitLocker involuntarily turned on and locking whatever remains on your hard drive(s), unrecoverable for most without a Microsoft account)

Hate to break it to you, but a company is not a charity. Or a government. It is there to make profits. It has fiduciary duty to its shareholders to do so. Is it bad that in pursue of profits many companies start practices that are harmful to society at large? Yes. That's why there must be a functioning government and strong political system to regulate them, especially large businesses.

 

Unfortunately, in all cases - when a business becomes too big, like Microsoft - it also starts influencing governments. Either through legal methods (lobby) or illegal ones (corruption). Asides from that, some businesses, like - again - Microsoft - can become uniquely positioned and offer governments something more and valuable than kickbacks or raw money. They can offer power. I am 120% confident that Windows crackdown on user privacy and draconian controls progression as times goes by benefits certain 3-letter agencies; I'm 120% sure internally all those "Clouds" feed into the data streams of those agencies directly. Total population control is on the map and those in power will not let go.

Frankly I'm impressed Nexus is still running. Pretty soon I'm sure anyone in New Nigeria is going to serve life imprisonment unless a mod is state approved. They'll probably even have a government agency branch to monitor all mods.

No... I don't need any more foil hats... I have like 10 already, but thanks.

The solution is, always has been, will always be, if you don't like it, make your own and enter the free market arena.

The sad thing is that this short term thinking screws them in the long term.

 

When phones started to become the new thing MS tried to make their own phone platform. It was apparently very good, but so many people were pissed at them for the shit they pulled in the late 90's/early 2000's that they just never gave it a chance.

 

See also Google Glass and a lot of Facebook/Amazons hardware offerings, nobody wants to buy gear that could spy on them from the companies that already spy on them.

The pressure was from trying to get better ad dollars, if your site has porn you're very limited in who will advertise on your site and the pay for those ads is really low. They thought they could nuke the porn and get better ad buys, but everyone just up and left. Youtube used to have hardcore porn and an easy to avoid age restriction long after Google bought it but slowly those that paid for it, the advertisers, wore them down and now you can't even say word like suicide or kill without getting demonitsed.

Proof? Because I don't think so. I live long enough to remember yt pre-google. It was never a serious source for adult content. Maybe it had some fringe  groups that did something dodgy but that was it. Age restriction they don't have even now - not a proper one anyways, but that's besides the point.

 

Now, yt is actually a bad example against adult content anyways - regardless of its past - because of its rampant issues with fraudulent businesses advertising on the platform. Scam ads is such a huge issue that even aforementioned 3-letter agencies recommended to enable ad blockers to improve security. Point is - yt is far from being a paragon of virtue with its endless stream of sex-advertising bots in comments or "models" fishing for OF subscriptions. It's still a major part of their business - because you know what? Scammers pay top dollar when it comes to ads. And the kicker is? They wouldn't be doing it if it didn't work.

 

So - sure, yt doesn't host adult content (sex/gambling/loan sharks/scams or in some countries even glorified drug dens). It doesn't need to. It has all the advertisers that are happy to use it as a hub to route traffic to those resources.

Yes - to both. The only thing they care about is making all the profits they can. And in most cases, that's short-sighted and the profit is short-term. And yet they still do it. Don't get me wrong, I'm not defending the model. What I don't like is people being generous with someone else's money. If anyone is asked, what's better, $120bil or $150bil, they will always choose the latter. Especially as investors into the company. That's just math. It's nice to talk beautiful speeches about kumbaya and all those great things for society and high taxes .. until the speaker is the one that has to pay. Then suddenly things change and "it's actually complicated" and "things need to be looked on" and "well, actually.."

 

But yeah. Short-sighted squeezing maximum profits from society is bad long-term. Leaving aside the ecology - which will at some point hit all of us - having too big inequality is just bad economy. If a large part of society cannot even meaningfully participate in the economy because they're dirt poor - that's the part of the economy that doesn't work. It'd be much better for long term profits if close to 100% of people could trade goods and services, rather than top-10%, but here we are. I also ignore societal unrest here and costs associated with it because it's hard to quantify since it's hard to predict. But crime rate and similar outcomes will definitely make things worse, not better.

See... the funny part is that the Tin Foil hat theory isn't wrong. RF waves are proven, time and time again to interfere with brain delta waves, sleep patterns, and ultimately thinking patterns. Multiple neuroscience whitepapers confirmed this. Fun projects like ******* discovered certain frequencies can alter moods, such as 19 hz, can illicit fear symptoms. Is it really a stretch to say that if a government uses this knowledge to help sell emotion fueled ideas... like certain **ahem** lockdowns?

So, when a person offers me a tin foil hat... sure, I'd prefer copper or RF resistant paint, but I thank them anyways... after all, they're probably too ignorant to even know what RF even is.  I might even pat them on the head and tell them they're a good normie, which ofc confuses them because they meant it as an insult... but can one really be insulted by a read-only NPC that can only be flashed by approved state media?

I realize you might know what Herz means and that you're trying to be smart.
Here's the syntax of my argument: Tinfoil / copper mesh / RF resistant paint works at stopping frequency ranges. Sure, that doesn't include 19hz, I just this an example because it's the most well-known example: (The brown noise).

M'friend, there is a TREMENDOUS difference between sound and electromagnetic/radio.  

And I think your '19Hz' is mis-remembered.  Check out the Wikipedia article as a primer (which says the infrasound you're thinking of is about  7Hz, not 19Hz).

 

If one is trying to shield against lower-frequency photons, aka 'electromagnetic waves'/'particles', what to use depends on what frequency/ies one is trying to reduce.  There's this wacky stuff called mu-metal which works pretty well at lower frequencies.  

 

If you want to get good information on shielding, look up ham radio information, as they may deal with anything from single-Hertz ELF up to gigahertz; and the sanest 5% of the audiophiles.  The rest of the audiophiles degenerate into lunacy like taping magic rocks on their cables... {humor} maybe they need some tin-foil hats on their heads and not just their electronics! {/humor}

Blocked in Britain all adult skins, body mods, everything because of Face ID basically turned Britain in a child only country. It will happen else where if you do not fight back. Nexus now has all adult mods removed. Dumb real dumb cannot use Face ID on a computer only mobile cell phone. Every adult porn you name even sniffs that way is blocked. This is total control of the population. Have yet to see face ID work on my iPhone yet, Face ID is a Scam?. Nobody here wants any kind of ID.
