marno Posted September 19, 2024 Posted September 19, 2024 Could this be the coming end of Palworld, or do you think pocket pair will survive?
DragonkingKyo Posted September 19, 2024 Posted September 19, 2024 I don't believe it as for one that says September 19th when it is still the 18th. Plus, even if they did, they would lose as an art style isn't copyrightable/patentable nor are game styles (which it isn't even the same style game) some pals being similar to pokemon isn't infringement they have to be near identical like 90% identical which they are not (well maybe the penguin is). If it was infringment then pokemon can be sued by dragon quest as their gen 1 design are literally dragon quest monsters in a different art style

OtakuNeko713 Posted September 20, 2024 Posted September 20, 2024 Everybody needs to understand a few things 1.) This is a lawsuit based between two companies in Japan, and as such Japanese Laws will apply. 2.) Nintendo is suing Pocketpair for Patent Infringement, meaning Nintendo believes that one or more of their internal logic processes has been infringed upon. Patents in Japan can be granted for data based things like coding script in video games, as well as physical inventions. This is rarely the case in America, where such things would need to be registered as a copyright or Intellectual Property. 3.) The above posted patents from May 2024 are re-applications to the American patent board for systems that have been in place since Let's Go Eevee/Pikachu. Nintendo has patents in Japan for these systems that were renewed when Legends Arceus was released, and again shortly after ZA was announced. 4.) Pocketpair was only cleared of Copyright Infringement, the Pal designs having been deemed 'Unique' enough that they would stand on their own against the infringed designs (i.e. the loophole that allows poorly altered bootleg products to circulate) Whatever the case, this has literally just happened and it the early stages of announcement. We have yet to see whether or this will even make it past the initial review, where if it fails any of the checks it gets thrown out and cannot be filed again in the same manner. Personally I feel like Nintendo is just reaching at this point to knock away any potential competition to ZA. 1

Sera67 Posted September 22, 2024 Posted September 22, 2024 (edited) From what I read the case is based on Nintendo Patent for using items via control sticks to capture monsters with Held items. (better wording on other sites) This was put changes mid this year. (forgot dates read thru a few articles on it) Palworld release before this. Several games use this method, And appears no one bothered to put in a Patent for it. So Nintendo did.. and got it. Patent trolling at its finest. Covers it really well. Kelvryn Posted September 27, 2024 Posted September 27, 2024 There is no way Nintendo wins this case if Pocket Pair stays in the fight. The patent is over broad and could apply to anything from actual Pokemon to fishing games.
