To my knowledge, if  a person wants to commission someone to make a mod for them, that once made will be free for others to download, it perfectly fine.

 

The commission is just an enticement to make something that otherwise probably wouldn't be made.

 

The mod maker usually retains the rights to the mod unless the individual commissioning the mod has specified they are purchasing the rights to it also.

No lawyer ofc. But i think also it works that way.

"Illegal" in what province/country?  Most laws don't have anything explicit about modding.  Might be covered under contract law, but that's it.

 

If someone commissions an author for a unique piece of work and part of the commission includes not making it public, then there might be an issue, but that is fairly rare.  Most commissions are just as others have said: the author agrees to make it, and it likely goes public afterward.
