Kashiwaba Tomoe Posted July 20, 2012 Posted July 20, 2012 So yeah, here's the thread I'm spinning this off from. Now back to the discussion: here would be my ideal legal system, basically common sense stuff that doesn't hold the hands of idiots. 1- Minimalistic. Currently we make new laws when someone breaks old ones, so just enforce the damn law rather than add more red tape. 2- Easy repeal. Every presidential election, have voting also be on laws that have had a certain percentage of the electorate sign a petition against be up for vote. If 40% vote to repeal it, it immediatly ceases to be in effect, and those in jail just for that charge get out right away (barring other crimes) 3- Sentancing. Violent crimes, child molestation, and those that endanger the public good (say, a politician taking a bribe as one example). Those three types should have mandatory sentances to hard labor, and parole should simply not be allowed for them. But yeah, bare bones of what would make folks not want to do the crime, or at least making sure they actually feel punished for it.
Kamen Rider Kuuga Posted July 21, 2012 Posted July 21, 2012 I'm somehow a tree hugging hippie, so anything I would say would be mocked by everybody here. So fuck it.

If I ever mocked you or disagreed in a disrespectful manner, I'm an idiot and sorry. I think I can come across strong on this topic because I'm usually surrounded by people who would probably tend to more agree with you. I live in a "tree hugging hippie" city (only borrowing your phrase and not meaning to be an idiot again(wasn't it greg that first called you that?(gregathit!!!)).
Symon Posted July 21, 2012 Posted July 21, 2012 Ah, legal systems? OK, first I'll say I'm not aware of any country in the world that has a legal system that works. Most manifest some or all of these major flaws:- * The legal system is not dedicated to arriving at the truth. * The legal system is not dedicated to arriving at the correct and best decision for all. * The legal system is not dedicated to making sure a guilty offender does not transgress again. * The legal system is not dedicated to making sure an innocent accused is acquitted or receives a proper, effective apology. * The legal system does not have a clear single goal. Is it aimed at revenge, restitution or prevention? * No one is held to account for getting the wrong result, ever. * Many laws are arbitrary in their scope or application. * Laws are often framed in such a way as to be incomprehensible to many. * Punishments are often very severe when applied to 'lower social orders' but slaps on the wrist when applied to the rich and famous. Fines are especially bad in this respect. A massive punishment for one person can just be a 'fee' paid to do something by another. * No sanction is ever applied to participants who get the decision wrong, whether they end up acquitting the guilty or punishing the innocent. Juries make decisions in secret and are never held to account if their result is wrong, let alone revealed later as manifestly wrong-headed. * People play politics with justice for headlines or electoral chances. * Numerous participants have an interest and the power to conceal information from a jury, the defendant or even the Judge. I have my own 'solutions' to the mess all countries have at present, but as they will never be applied anywhere, are probably not relevant.

[/quote'] I could not agree more, many people have chosen to forget the atrocities committed by the justice system in america simply because it's easier to do that then admit to being accomplice to murder. I have not and will not forget the innocents that the state of Texas Murdered in there assembly line execution system, nor will I forget the murder of Vicki Weaver, and countless others. Justice in america exists only for the rich and powerful anyone who is neither of those can and will fall victim to it
prideslayer Posted July 24, 2012 Posted July 24, 2012 I could get behind an automatic 5yr sunset on every law, unless actively reauthorized.
thesapien Posted July 24, 2012 Posted July 24, 2012 I kind of like that, similar to wiping a cluttered drive and reinstalling the OS. I would add that the authorization must pass a vote by elementary school students. They must be able to understand it well enough to know what it means for their future. Not saying they write the laws, just veto power. Plus, it would be a great class project for kids, to get them thinking about such things and feeling like their own education really matters. It might also get us thinking that our kids education matters!
Kashiwaba Tomoe Posted July 25, 2012 Author Posted July 25, 2012 One BIG change: REQUIRE all laws be written in the everyday language of the people it applies to, NO legal language period. Do that, half of laws would vanish I bet.
