That said, it depends. If the original author's page gives permissions (see the credits/permissions section) to use/modify/whatever then yes. If it specifically states no, then no. Nexus moderators are finicky. Some may let it slide, while others may instaban you. It's ultimately up to each moderator and their own discretion. The author saying "I'm leaving and never coming back" does not mean they're giving any permissions to do anything. I've seen many a mod posted that's a rip-off or modification to another mod without stating they had explicit permission. Sometimes they stay up for months/years other times they're pulled within hours. I would accredit that to whether someone reports it, be it original author or another user trying to be an amateur police. I have a mod I ported from Skyrim to Fallout 4 but I can't post it anywhere because the author has been M.I.A. for over 2 years. The author's page says to ask permission first. Well I did. I didn't get a response either way. It's probably ok for me to post it, as the author would likely give permission, but I don't want a ban anymore than the next guy. FWIW the mod I ported has over 80 man hours of work on it. Custom remodeling, texture fixes, UV fixes, and additional texture options. You could probably post the modified version here without fear of an instaban. Be aware that a moderator may take it down and speak to you about it, if it were to become an issue. The largest problem with any hosting site/board by far is a concern regarding the use of copyrighted material. If one wanted to get legally technical you could say that any original material created by an author is then their right to control the copying and distribution of such. So that author would automatically have a copyright on any original material they created. Whether they would desire to enforce it or not is then up to them. IIRC U.S. copyright laws stipulate that one has to be ready and willing to enforce their rights for copyright infringement in order to retain the legal rights under copyright law as well. So that companies don't selectively go after only deep pocket offenders and such.
