Yes you can, because that's not how licences work. Licences are for any kind of creative work. In fact, mods should be licenced. Otherwise, permission to do literally anything with the work is only available to the authors (considered proprietary). Technically everyone submitting mods, no matter where, should be using licences, just most people don't think about it and don't have a problem with people using their stuff. Any work submitted without a licence, again, basically gives no one any kind of permission. Even stuff like custom firmware (mods that companies DEFINITELY DON'T WANT YOU TO USE because that's what let's you mod your consoles and stuff) is licenced. Take a look at Atmopshére's (CFW for the Nintendo Switch) if you want an example. Being licenced allows people to continue its work even if you aren't the original author. They have a clause even stating that Nintendo is allowed to bypass any terms of the licence and use their code freely. When most people think of licences, they generally think "ooh scary legal stuff for big corpo" but in reality it's there to help people. But because it's copyrighted material based on an IP they don't own, I don't think they can do anything about it if we were to edit it. They can remove it from GameBanana and Discord since they have control there, but they can't do shit here. If they actually go after us by trying to take down our mods, it'll just cause a Streisand effect, making the mod more popular than they ever wanted while they're dancing around the legal fire over a character model bearing the likeness of a commercialised copyrighted character they do not own.

I recommend you do the same if you'd like to learn more about them You're only right about one thing: any original code written from scratch belongs to the author and can be licensed to protect it from other modders. However, you are completely ignoring a massive legal reality: Derivative Works. When you create a mod built upon another company's Intellectual Property (IP), game engine, or assets, the license you attach to your files has zero legal weight against the game company itself. The second you violate their EULA, giants like Nintendo, Take-Two, or EA can hit you with a Cease & Desist. When their lawyers tell you to take it down, that license won't protect you at all. So, from the perspective of the actual property owners, licensing a mod that targets someone else's IP is practically meaningless—it’s a license in name only. The game company always holds the trump card. 1
