I think Skyrim is way too forgiving when it comes to commit crime, if you get caught you either spend a few days in prison or pay a fine.

Ex: If you thinking stealing crops and average value objects, not only you will pay a fine but also you get a hand cut off.

Stealing low value objects would be public humiliation, and lashes, either pay a fine or forced work for compensation.

Stealing several times will lead to cut of both arms and ears.

murder: is either perpetual prison or execution for hanging.

 and other types of crime like misconduct, drunkedness, publicly talk bad about the rulers, will lead to the stock or gibbeting.

 

Prison weren't free to stay, the prisioners have to rent for the cell and food, if he couldn't, it would be given the most basic cell, and food would be given if someone feels "charitable" enough.

The Guards aren't responsible for the welfare of the prisioner, their responsability is to ensure that no one escapes, so the guards could exort, torture, rape, humiliate and so on.

However if the prisioner is a rich person, it could bribe the guards for release if the price is right, or getting a better treatement, improve the cell until release or running out of money.
