Now first off, if I am wrong in any way with this post, I apololgise wholeheartedly. Apologies also if this has already been posted.

 

So I was browsing C4S because I am a degenerate, and I came across the store I linked above. Immediately recognizing it as TS4, I went on to have a look and sure enough, it seems that someone is making money selling WW animations. Now I know nothing of copyright or if this is actually an issue at all, but am I wrong in thinking whoever runs that store is crossing some sort of line? Afterall Wicked Whims is TurboDrivers creation, and those animations were made by various people in this community, and it just seems to me like someone is unfairly piggybacking on the work of others. Am I right to bring this to attention?

It almost certainly violates the terms of use of WW and the various creators (one would have to check), and probably EAs as well, although obviously it could be difficult to enforce. If such a creator were so inclined, they could send the host forum a demand letter demanding that they take down the violative content.

I believe they are selling not animations but videos, produced by their own plot. Something like shooting porn or making custom sims - you take all the assets made by other creators and use them to create something yourself.

When someone makes a custom sim and makes available a bundle of the cc of others, they are typically violating the TOU of the cc creators. Again, hard to enforce.

Actually for what it's worth, it doesn't look like WW's TOU would prohibit it. But you'd have to check and see if any of the other creators have TOUs that would restrict it. Anyway, no one is going to sue over this so the only possible remedy would be to try to take it down.

Ya know, I thought about it some more and looked at the language in EA's TOU that some are familiar with (see below at the bottom). As I said before, no one is going to sue or litigate over this stuff except EA itself (in theory), but - that being said - I think everyone can take the view that users of cc are "intended third party beneficiaries" of the below language and therefore can use said cc to create derivative works without restriction or attribution, even if a content creator includes a restriction in their TOU. So I think Simpossible is right. This is not legal advice, just a thought exercise!

Imho, EA will do nothing except if CC porn content is exposed on public place without age restriction. A non negligeable part of EA customers bought TS4 because there is porn/sexy mods. They just don't want public outrage, but they want the money.

 

Concerning TOU cc creator violation, it's costly and difficult to do legal actions against the culprits. And a lot of CC creators violate themself EA TOU by not providing in a "reasonable" time their content free.
