As I recall, one of the given reasons for the FCC's repeal is that any throttling/blacklisting behavior by providers would constitute a Sherman Antitrust violation anyway, at which point it falls under the purview of the FTC and the monopoly-busting begins. I've never gotten around to reading the applicable bureaucratic junk, though.
