Fair use and copyright? Using sounds from movies and celebs

I was thinking about using voices and sounds from movies to get around needing voice actors. Is this ok, or would it get deleted from uploading to say, nexus or Bethesda?

 

also, can I use celebs and add their real voices from movies? I see already plenty of celebs as followers. 

 

Was as thinking of making Taylor swift as my housewife, have instrumentals of her music in the house, and have her posters on the wall. And then go bang her.

Using music that is copyrighted is not possible, in all games.

 

Creating a set of meshes and textures, that looks like a celebrity is possible.

But avoid using not-public material.

what about using an instrumental version of the song, like from those people on YouTube? And what about using voices taken from say, an interview? Like a yes, no, of course, etc. or those things copywrightes too?

 

There's a Annie Leibovitz photo of Taylor swift as repunzel sitting by a window of a castle tower. Was thinking of taking that picture and  making it into a painting. This allowed or no?

I think... you probably could use music (if you bought it property) and voices... but you Have to give full credit to creators and actors.. and names, titles and such.

Making followers that look like celbs is fine but also depends on what resources you use to make them. If you use other peoples resources then you will have to have permission before you can upload them. If anything is copyrighted and you upload it to the nexus they will remove your upload and take action against you weither it'll be a boot in your ass account restrictions or a ban.  

 

I don't have any dealings with bethesda site so I have no clue on that site over there.

Not unless it free to use stuff. If it's copyrighted it will be removed from the nexus as soon as it's reported.

Anything that is copyrighted can't be included in a mod you are uploading to the nexus. Other sites might also do similar if they get a report.

Well... I really doubt some lawyers of Taylor Swift hang out in adult mod game sites, stalking someone, who created her. Unless, hard-core fans reported it.

You could always rename her... and yeah, it would greatly help.

Whether or not something can be termed 'fair use' tends to fluctuate according to the case and the jurisdiction. Using a substantial amount (more than a few seconds) of copyrighted music or movie dialog for no other purpose than to have some nice music or cool voiceovers will probably not be considered fair use, so that makes it simple copyright infringement if you don't have permission to copy.

Same song, same story. Whether or not 'those people on YouTube' hold a copyright on a particular performance or recording of a song doesn't change the fact there is one on the song itself.

The medium that published the interview may hold a copyright on it. It's quite likely, in fact.

The actual person being interviewed can maybe assert a personality right on the use of their voice or likeness in a mod, but on the whole something like that is rarely pursued when it comes to non-commercial use of a person's likeness, voice, mannerisms etc. (Unless, of course, it really upsets them.)

Not without permission. It's not LL's job to give it or withhold it, the copyright holder does that.

Giving credit doesn't give you permission to copy from somebody.

A key foundation of Fair Use is amount and substaintiality, how much you use it and how prominently do you use it. 

 

Making a follower using celeb's likeness is definitely OK for non-commercial distribution, as long as you don't claim it as an actual or authorized representation. 

 

For others I am guessing:

1. A few seconds of music in the background is probably fine, play the whole song likely no. 

2. A few words or maybe even a sentence or two may be OK but would depend on the source and context of usage.

3. Using Annie Leibovitz's photo as a small hanging pic in a house mod is tricky.  US courts have ruled that tumbnails are fair use in search engines.  Having the said pic taking up an entire wall is definitely no.  Also, the photo itself would be the entirety of the copyrighted material so likely would be no too as you are using the whole thing.

 

There is also an issue of the means of distribution.  Nexus is a for-profit outfit so putting your mod there would definitely trigger non-commercial alarm.  This is why Nexus is super sensitive in anything copyright related.  Nevertheless Nexus hosts plenty of celebrity likeness followers.  Youtube is also for-profit but Google has a lot of legal wiggle room in copyright infringement and has implemented an umbrella protection for its uploaders in Fair Use defense, which is why you see a lot of copyrighted stuff there.  Youtube is also different from Nexus in that Nexus can only operate with the approval from game publishers who own the IP.  So it's up to the site that you plan to upload it to.  I think I've read posts from LL moderators telling modders not to include anything from commercial properties in the Download section but other sites may adopt a more broader view of Fair Use in case of images and voices.
