What's okay and not okay with texture replacers?

Say that I made a personal texture replacer for all the painting on FO4, but they're either pics from paid porn sites or screenshots I also took from said websites. I would think it would be okay releasing something like that publicly, as you can't exactly copyright or claim ownership to a body, but then again the images themselves might be. Basically would that be allowed?

This is the exact reason why I don't release mods. More drama than fun. Anyways I have no clue, but I would imagine if you had to buy the image/s (or access to them anyways) that it would be against their rules to offer them freely; and most likely LL too.

For the legality of it it is simple. Unless the IP owner gives you permission -- directly or through a licence --  you cannot really use the this as is. If you modify it to express something else (ie not just take a screen grab and put it as a mod) you may be covered by fair use (although you have to prove that you used the IP to do/express something more) but this does not appear to be what you have done.

 

In short what you describe is legally against you in the eventual the IP holder  find this and are not cool with it they could sue you and probably would win.

 

The image you slap on the texture is not only the body but also a set-up which was nice enough to make to appealing to you so the author as right to this. And even for the body there are  legality  aspect the person was OK to give his/her image for this piece of media they may disagree with it being slapped in another piece of media without their consent (although it is less likely than the producer of the movie).

 

 All that being said you can give it a go and hope that your mod will remain small enough to not represent an issue or a threat for the IP holders. Just be aware that unless you give some transformative modification to the image that would be deemed enough by a jury to be covered by fair use (which is tricky) you are legally wrong. But  also typically the process start with a cease and desist which -- if you comply to it -- typically is not going further than that.

That's what I was worried about to, since I did pay money to access them; but then I was curious because you can't copyright a body, so it would seem a little silly that you couldn't use parts of the photos/screenshots of videos for non-profit stuff since all they're showing is the human body.

Don't you have to demand payment for your mod for such to be illegal? As long as the mod is free and the pictures from the site you use is free there should not be a problem I think. You should probably check this proper though. I don't want to be responsible for you ending up like Eric:
